These Terms of Service govern all orders, purchases, and use of products and services provided by Over-The-Top, a subsidiary of Flyers Cove Media Inc. By placing an order, submitting content, or using our services, you confirm that you have read, understood, and agreed to these Terms.

About Over-The-Top
Over-The-Top creates custom sports trading cards and related products using customer-submitted information, images, and optional AI-assisted text generation. Products are created as keepsakes and collectibles and are not official league, team, or licensed trading cards unless explicitly stated.

Eligibility and Authority
By placing an order, you confirm that:
You are at least 18 years of age
You are the parent, legal guardian, or authorized representative of any minor featured on the cards
You have the legal authority to submit all content included in your order
You are solely responsible for ensuring that all submitted content complies with these requirements.

Customer-Submitted Content
3.1 Ownership and Rights
You retain ownership of any photos, names, likenesses, or text you submit. By submitting content to Over-The-Top, you grant Flyers Cove Media Inc. a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, crop, resize, and print the content to create trading cards and related materials.
Unless you opt out in writing, you also grant permission for Over-The-Top to use images of the final cards for portfolio, marketing, promotional, and social media purposes.
3.2 Content Accuracy and Appropriateness
You are responsible for reviewing and approving all submitted information including names, statistics, biographical details, and descriptions.
Over-The-Top is not responsible for factual inaccuracies, misrepresentations, or subjective interpretations included in customer-approved content.
3.3 Prohibited Content
You agree not to submit content that is offensive, defamatory, abusive, sexually explicit, discriminatory, hateful, or in violation of any law.
Over-The-Top reserves the right to refuse or modify content at its sole discretion.

AI-Generated Text and AI Image Processing
Over-The-Top may use artificial intelligence and automated tools during production and pre-production to prepare submitted content for print quality and design presentation.
This may include text assistance and image processing such as quality enhancement, upscaling (increasing image size), background cleanup, color/lighting correction, and creative adjustments for visual effect.
You acknowledge and agree that:
AI-generated previews are provided for conceptual and review purposes only
AI-generated content may contain errors, omissions, or unintended phrasing
Submitted images may be modified, enhanced, resized, or otherwise manipulated to improve print quality and/or card presentation
Over-The-Top is not required to provide unedited previews for every AI-assisted image adjustment applied during production
Final production cards may differ from on-screen previews due to card size and format variations, design layout constraints, font scaling, spacing, and line wrapping
Line breaks, wording placement, and text length may be adjusted during production
Over-The-Top does not guarantee that AI-generated preview text will match the final printed layout verbatim. Final production decisions are made to ensure the best possible visual presentation on physical cards. Customers remain responsible for reviewing and approving the content itself, not the exact preview formatting.

Privacy Policy and Data Use
By submitting an order, you consent to the collection and processing of submitted personal information and media (including player names, team details, and uploaded photos) for order fulfillment, quality control, customer support, and production operations.
This includes AI-assisted processing of submitted images and text to improve quality, increase image size, and apply reasonable visual adjustments for production and design effect.
Over-The-Top will not sell personal information. Information is used only as needed to provide and improve services, comply with legal obligations, and maintain service integrity.

Production Variations and Imperfections
Over-The-Top cards are custom-produced and may include minor variations, including but not limited to:
Slight off-center cuts
Minor color differences
Small alignment inconsistencies
Minor surface imperfections
You acknowledge that these variations are a normal part of the card production process and do not constitute defects.

Errors, Reprints, and Replacements
6.1 Production Errors
Over-The-Top will replace or reprint cards only in cases of confirmed production errors caused by us, including misspellings introduced during production, incorrect layouts not matching approved content, or printing defects beyond normal variation.
6.2 Customer Errors
Over-The-Top is not responsible for errors resulting from incorrect information provided by the customer, content approved by the customer prior to production, or late changes requested after approval. No refunds or reprints will be issued for customer-submitted errors.

No Refunds on Custom Products
All products are custom-made. All sales are final. No refunds are provided once production has begun. Exceptions may be made solely at our discretion for confirmed production errors.

Promotional and Marketing Use
Unless explicitly opted out in writing, you grant Over-The-Top permission to photograph or digitally display completed cards and use images of cards for marketing, website content, and social media. No personal contact details will ever be shared.

Intellectual Property
All designs, layouts, templates, branding, and original artwork created by Over-The-Top remain the exclusive property of Flyers Cove Media Inc. You may not reproduce, resell, or distribute Over-The-Top designs without written permission.

Limitation of Liability
To the fullest extent permitted by law, Over-The-Top and Flyers Cove Media Inc. shall not be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the order.

Indemnification
You agree to indemnify and hold harmless Over-The-Top and Flyers Cove Media Inc. from any claims, damages, or legal actions arising from submitted content, lack of rights or permissions, or violations of these Terms.

Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

Changes to These Terms
Over-The-Top reserves the right to update these Terms at any time. Updated Terms will apply to all future orders.
